ORDER

This writ petition is filed for a direction to the respondents 1 to 3 to dispose of the petitioner's representation dated 28.04.2023 in accordance with law.

2. It is the grievance of the writ petitioner that private respondents have entered into a partition deed claiming to be the owner of the property. According to the petitioner such transaction is a fraudulent document. Therefore, the petitioner has given a representation to the authorities to cancel the document under Section 77-A of the Registration Act.

3. Heard both sides and perused the materials available on record.

4. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

5. The very allegations contained in the representation would indicate that the partition deed was registered in the year 1999, now a representation is given in the year 2023 and the allegations does not indicate any forgery of instrument.

6. Such view of the matter, as a matter of right, the petitioner cannot invoke the jurisdiction under Section 77-A of the Registration Act. Accordingly, this writ petition stands dismissed. No costs. It is for the petitioner to work out his remedy before the appropriate Court, if properly advised.
