A.No.422 of 2021 in C.S.No.296 of 2018 R.PONGIAPPAN, J., This application has been filed to condone the delay of 945 days in filing the written statement of the fifth defendant in C.S.No.296 of 2018.

2. The learned counsel for the respondents has no objection in allowing this application.

3. Having regard to the nature of averments mentioned in the affidavit filed in support of the application and also in order to give a fair opportunity to the applicant to defend the suit, I am inclined to condone the delay.

4. Accordingly, this application is allowed.

5. Written statement of the fifth defendant is received. List the matter on 24.03.2021 for filing written statement of D1 to D4.
