This Writ Petition has been filed seeking a direction to the respondent to consider the petitioner's Representation dated 07.12.2023. 1/4

2. It is the case of the petitioner that he had submitted a representation dated 07.12.2023 to the respondent requesting confiscation of passport of one A.Kalanidhi who is the accused in Crime No.174 of 2022 on the file of the Assistant Commissioner of Police, CCB (Job Racket), Greater Chennai Police for the offences under Sections 406, 420 r/w 34 IPC. However, the said representation has not been considered so far. Hence, the petitioner has come up with the present Writ Petition seeking the aforesaid relief.

3. Learned counsel appearing for the petitioner submitted that it would suffice if this Court issues a direction to the respondent to consider the petitioner's representation dated 07.12.2023 and pass appropriate orders within the time that may be stipulated by this Court.

4. Learned Senior Central Government Standing Counsel on the basis of the Counter Affidavit filed on behalf of the respondent submitted that, as per Section 10 (3) (h) of the Passports Act, 1967, there is no provision available for the authorities either to confiscate or revoke the passport unless there is any warrant or summon has been issued for arrest of the passport holder by the court under any law.

5. In view of the stand taken by the learned Senior Central Government Standing Counsel for the respondents, this Writ Petition stands disposed of. There shall be no order as to costs.
