ORDER

This petition has been filed under sections 3, 7 to 10 and 25 of the Guardians and Wards Act VIII of 1890 to declare the petitioner as the sole guardian of the person of the minor child named Ryan Kyler and grant permanent custody of the minor Ryan Kyler to the petitioner.

2. The petitioner, Michael Pradeep, is the father of the minor child and the respondent, Sharmila Azariah, is the mother. The marriage between the parties was solemnized on 26.11.2012. Out of the said wedlock, the minor child Ryan Kyler was born on 01.12.2013.

During the pendency of the proceedings, both parties have settled the dispute between themselves and entered into a Memorandum of compromise dated 15.06.2026.

As per Clause 7(b) and 7(d) of the Memorandum of Compromise dated 15.06.2026, the petitioner/father has agreed for permanent custody and guardianship of the minor child Ryan Kyler with the respondent and to facilitate reasonable visitation and access rights to the petitioner/father, at mutually convenient times, keeping the welfare and best interest of the child in mind.

5. In view of Clause 7(b) and 7(d) of the Memorandum of Compromise dated 15.06.2026, this Original Petition is disposed of by recording the said settlement. Clause 7 (b) & 7 (d) of the Memorandum of Understanding dated 15.06.2026 shall form part and parcel of this order. No costs. Consequently, all the connected applications are closed.
