2023-01-25Honourable Mrs Justice T.V.Thamilselvi3 pages

T.V.THAMILSELVI, J.

This matter was taken up for hearing under the caption "For Clarification" today.

2. Earlier, this Court by an order dated 25.01.2023 granted bail to the petitioner and also issued direction. However, in para-8 of the order, instead of giving direction to the concerned District Collector to grant interim compensation as per the Victim Compensation Scheme, a direction was given to the concerned Legal Services Authority. Hence, the matter is listed today.

3. In the said circumstances, paragraph-8 of the order is clarified as follows:

In Para 8 at Page 5 "8. On considering the pain and suffering and the welfare of the children of the deceased, this Court recommends that it is a fit case to refer as per 357(A) (1) (2) and (6) of Cr.P.C. to the Chairman, District Legal Services Authority, Chennai, is hereby directed to pass appropriate orders to the District Collector, 1/3

Chennai, for disbursing the compensation amount of Rs.1,00,000/- (Rupees One Lakh Only) as interim compensation to the parents of the deceased, in the manner known to law based on the available schemes within a period of 4 weeks from the date of receipt of copy of this order and the victim is permitted to withdraw the above said amount. "

4. Registry is directed to incorporate above correction in the Order of this Court in Crl.O.P.No. 1576 of 2023 dated 25.01.2023 and issue fresh order copy to the petitioner.
