2. Memo of service has been filed. It is seen that the fourth respondent has received private notice on 10.07.2024. Notice to other respondents has also been served. However, there is no appearance for the respondents either in person or through counsel.

3. Heard the learned counsel for appellant and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 50 days in filing the above appeal is condoned.

Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.
