Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the 3rd Respondent herein, who is the Enquriy officer in the Disciplinary proceedings in PR. No 22/2024, dated 26.11.2024 to furnish the documents sought by the petitioner herein vide his representation dated 28.02.2025, before proceeding further with the said disciplinary proceedings.

ORDER

This Writ Petition has been filed seeking a direction to the 3rd Respondent herein, who is the Enquriy officer in the Disciplinary proceedings in PR. No 22/2024, dated 26.11.2024, to furnish the documents sought by the petitioner herein vide his representation dated 28.02.2025, before proceeding further with the said disciplinary proceedings.

2. Mr.R.U.Dinesh Raj Kumar, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that while he was serving as Inspector of Police at Vedharanyam Police Station, a charge memo dated 26.11.2024 was issued by the second respondent. Pursuant thereto, the petitioner submitted his explanation, denying the charges levelled against him and, by representation dated 27.12.2024, sought copies of certain documents referred to in Annexure III appended to the said charge memo vide. Thereafter, the petitioner made several representations, the final one being dated 28.02.2025 addressed to the Additional Superintendent of Police, Nagapattinam Distirct, who was then functioning as the Enquiry Officer. However, the same was not considered. In the meanwhile, the Enquiry Officer was changed and the third respondent herein was appointed as the Enquiry Officer. The third respondent vide proceedings dated 05.

09.2025, informed the petitioner that the documents sought for by him could not be furnished and called upon him to co-operate for the oral enquiry. Though the petitioner had made several representations seeking supply of the relevant documents, none of them have not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the third respondent to consider the

representation of the petitioner dated 28.02.2025 and pass appropriate orders on the same, and to furnish the documents sought for by him, within the time that may be stipulated by this Court.

5. Mr.R.U.Dinesh Raj Kumar, learned Additional Government Pleader appearing for the respondents submitted that the petitioner's representation dated 28.02.2025 had already been considered and rejected.

On a perusal of proceedings dated 05.09.2025 issued by the third respondent, this Court finds that the petitioner's representation dated 28.02.2025 had in fact been considered and on order dated 21.04.2025, was passed to the effect that upon the petitioner placing his defence, the documents sought for by him would be considered and furnished. However, it appears that the said order has not been communicated to the petitioner.

7. In such a view of the matter, the third respondent herein is directed to communicate the order dated 21.04.2025 to the petitioner forthwith. Liberty is granted to the petitioner to proceed further in accordance with law, upon receipt of the said order.

8. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
