ORDER
This writ petition has been filed, challenging the impugned order dated 15.11.2025 passed by the third respondent, rejecting the petitioner's application seeking for issuance of patta in his name for the property, morefully disclosed in the affidavit filed in support of this writ petition. 2.The petitioner has challenged the impugned order on the ground that the impugned order is a non-speaking order and the same has been passed in violation of the principles of natural justice. 3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.
4.As seen from the impugned order dated 15.11.2025, no reasons have been given for rejecting the petitioner's application seeking for issuance of patta. The impugned order states as follows:
'The application 2025/0105/01/712786 is rejected by Tahsildar on 15.11.2025'.
5.As seen from the same, the third respondent, without assigning any reason, has rejected the petitioner's application seeking for issuance of patta and has not considered the supporting documents filed by the petitioner.
6.Since the impugned order is a non-speaking order and the same is passed in violation of principles of natural justice, the impugned order dated 15.11.2025 has to be quashed and the matter has to be remanded back to the very same respondent for fresh consideration, on merits and in accordance with law, within a time frame to be fixed by this Court. 7.For the foregoing reasons, the impugned order dated 15.11.2025 passed by the third respondent is hereby quashed and this writ petition is disposed of by remanding the matter back to the third respondent for fresh consideration, on merits and in accordance with law. The third respondent shall pass final orders, on merits and in accordance with law, after hearing the objections from the neighbouring land owners and any other third party whom the third respondent deems it fit to enquire, after giving due consideration to the supporting documents, filed by the petitioner, within a period of 12 weeks from the date of receipt of a copy of this order. Consequently, connected WMP is closed. No costs.
