Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the order passed by the 2nd respondent vide Na.Ka.K1/788/2024 dated 30.12.2024 and quash the same as illegal arbitrary and against the principles of natural justice and further directing the 2nd respondent to re-convey the land comprised in Survey No.65/1A measuring an extent of hectare 0.20.0 Ares (Acre 0.50 cents) Kothakatai Village, Vaniyambadi Taluk, Vellore District now Thirupathur District.

[Order of the Court was made by M.SUNDAR, J.,] When the matter was taken up, Mr.S.Arivazhagan, learned counsel on record for writ petitioner sought leave of this Court to withdraw the captioned 'Writ Petition' {hereinafter 'WP' for the sake of brevity} and Page Nos.2/6
captioned 'Writ Miscellaneous Petitions' {hereinafter 'WMPs' for the sake of brevity} thereat for the purpose of preferring a statutory revision under Section 10-A(1)(c) of 'the Tamil Nadu Land Encroachment Act, 1905 (Tamil Nadu Act III of 1905)' {hereinafter 'said 1905 Act' for the sake of brevity} along with a stay petition under Section 10-B of said 1905 Act.
2. Learned counsel sought leave of this Court to preserve all rights and contentions of writ petitioner to canvass all points and questions (including points raised in the captioned main WP) in statutory revision. Request acceded to.
3. Learned counsel has made an endorsement in the case file and a scanned reproduction of the same is as follows: Page Nos.3/6
4. If any requests for condonation of delay is made, the same shall be considered by the Revisional Authority on its own merits and in accordance with law de hors this withdrawal.
5. In the light of the narrative thus far, captioned main WP and captioned WMPs thereat are disposed of as closed / withdrawn albeit with preservation of rights in the aforesaid manner. There shall be no order as to costs.
