This petition is filed to condone the delay of 40 days in filing the above appeal in S.A.SR.No.5962 of 2019. It is reported that the legal heirs of the deceased first respondent are already on record as the appellant and respondents 2 to 5. The said memo is taken on file and the death is recorded and the respondents 2 to 5 are recorded as the legal representatives of the deceased first respondent. The Registry is directed to carry out necessary amendment.

The second respondent has passed away as early as in the month of August 2021 and the death of the second respondent had been reported. However, no steps have been taken till date. Therefore, this C.M.P.No.8780 of 2019 is dismissed as abated as against the deceased second respondent.

The other respondents have not entered appearance either in person or through counsel. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the delay in filing this second appeal is condoned as against the respondents 3 to 6.
