ORDER

The petitioner, seeking transfer of D.O.P.No. 84 of 2023 pending for the learned Principal District Judge, Krishnagiri, is the wife, who has been arrayed as the respondent in the said proceedings. 2.I have heard Mrs.N.Devi, learned counsel for the petitioner / wife 1/6

and M/s. S.Sengodi, learned counsel for the respondent / husband. 3.The learned counsel for the petitioner states that the respondent has filed I.D.O.P.No. 4951 of 2023 before the VII Additional Family Court, Chennai, seeking divorce. The petitioner has also filed M.C.No.604 of 2023 on the file of the V Additional Family Court, Chennai, and the said proceedings are pending. In the meantime, the respondent / husband has filed D.O.P.No. 84 of 2023 before the learned Principal District Judge, Krishnagiri.

4.The learned counsel for the petitioner / wife further states that the wife is a permanent resident of Chennai and she is also blessed with a minor girl child, who has to be taken care of and it is not possible for her to attend the hearings at Krishnagiri, which is about 270 kms away from Chennai. The learned counsel for the respondent has not seriously objected to the request of transfer since admittedly, connected proceedings are pending before the Family Court at Chennai. In the light of the above, I am inclined to accept the transfer request of the petitioner. 5.In fine, the Transfer Civil Miscellaneous Petition is allowed. The 2/6

case in D.O.P.No. 84 of 2023 is withdrawn on the file of the learned Principal District Judge, Krishnagiri and transferred to the file of the VII Additional Family Court, Chennai, to be tried along with I.D.O.P.No.4951 of 2023. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed.
