Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, Directing the 2nd respondent to register the settlement deed presented by the petitioner without insisting the original documents No.1066/ 2016, 1067/2016 and 792/2017 within a stipulated time.

The Writ Petition is filed for the following reliefs:- "Directing the 2nd respondent to register the settlement deed presented by the petitioner without insisting the original documents Nos.1066/ 2016, 1067/2016 and 792/2017 within a stipulated time."

2. The main grievance of the petitioner is that when he presented a settlement deed before the 2nd respondent, the 2nd respondent had simply returned the said document on the ground that the original parent deeds were not produced at the time of registration.

3. Heard the learned counsel for the petitioner and the learned AGP taking notice for the respondents 2 and 3.

4. Section 22- A of the Registration Act, which is inserted by the Tamil Nadu Act 48 of 1997, sets out the grounds under which the Registering Authority could refuse the registration. The reason that is given by the 2nd respondent for returning the document without registering it does not come within any of the grounds given in Section 22-A of the Registration Act. Therefore, the 2nd respondent is duty bound to register 2/5

the document.

5. Accordingly, the Writ Petition is allowed. The 2nd respondent is directed to register the settlement deed, within a period of 2 weeks, from the date of its representation by the petitioner.
