PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the learned II Additional Sub-Court, Salem to dispose the case in SC No.60 of 2008 within stipulated period.

O R D E R

This petition has been filed by the accused No.14 to direct the learned II Additional Sub-Judge, Salem to dispose the case in SC No.60 of 2008 at early.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioner has submitted that the aforesaid case is pending from the year 2008. For the past 12 years, no progress has been made and hence he requests to direct the Trial Court to dispose of the aforesaid case at early.

4. Per contra, the learned Additional Public Prosecutor has submitted that out of 26 witnesses, already 3 witnesses were examined before the Trial Court, as PWs.1 to 3 and now the case has been posted to 06.02.2020 for examination of other 1/2 https://hcservices.ecourts.gov.in/hcservices/

witnesses. He further submitted that a reasonable time may be fixed for disposing of the aforesaid case.

5. Considering the fact that the aforesaid case is pending from the year 2008, the respondent is directed to produce the remaining witnesses before the Trial court without taking unnecessary adjournments and the trial Court has to dispose of the case within five months from the date of receipt of a copy of this order.

6. with the above directions, this Criminal Original Petition is disposed of.
