O R D E R

This petition has been filed to quash the proceedings in S.T.C.No.220 of 2009 on the file of the Judicial Magistrate No.V, Coimbatore. The petitioner herein is arrayed as third accused.

In the final report, the petitioner was described as Sivadhesigan. When the summons was attempted to be served to the petitioner, he refused to receive the same. On his refusal, the respondent police was forcing, compelling and harassing the petitioner to receive the summons and to answer the charges. 3.

The learned Additional Public Prosecutor submits that on enquiry of the grievance of the petitioner and subsequent verification of facts, the respondent police had filed a petition under Section 321 Cr.P.C., before the Judicial Magistrate, No.5, Coimbatore and on 10.11.2016 the case now withdrawn.

Since the petitioner had been acquitted from the case nothing survives for adjudication and hence, the petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
