ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 03.11.2021 for the offences under Sections 302, 147, 148, 294(b) of IPC, in Crime No.633 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the deceased and the accused are friends and they had earlier jointly involved in commission of theft and after marriage, the deceased refused to join the accused person for committing offences and that the accused suspected that the deceased was giving information to the police about the illegal activities of the accused persons. Hence, the accused joined together and attacked the deceased with knife and committed the murder of the deceased. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and that he has been suffering incarceration for more than 80 days from 03.11.2021. Hence, he would pray for grant of bail to the petitioner.

4.The learned Additional Public Prosecutor would raise strong objection stating that the petitioner is arrayed as A3 and the other accused viz., A1, A2 and A4 have been detained under Goondas. 6.On seeing the gravity of offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
