..Respondent(s) PRAYER - This Civil Miscellaneous Petition is filed under Section 5 of Limitation Act, to condone the delay of 13 days in filing the Appeal Suit to set aside the judgment and decree dated 16.09.2025 made in O.S.No.111 of 2015 passed by the V Additional Principal Judge, Family Court, Chennai pending disposal of this Appeal Suit.

ORDER

(Order of the Court was made by C.V.Karthikeyan J.) The petition has been filed seeking to condone the delay of 13 days in filing the Appeal Suit against the judgment and decree dated 16.09.2025 made in O.S.No.111 of 2015 on the file of the V Additional Principal Judge, Family Court at Chennai. .The 1st, 2nd and 3rd defendants in the said suit are the appellants herein. The suit had been decreed in favour of the respondents. 2.It had been stated in the application that the delay is neither wilful nor wanton. Notice had been directed to the respondents and counsel had also entered appearance on behalf of the 1st respondent, who was the plaintiff in the suit.

3.Taking into consideration the fact that the Appellate Court has a duty to examine the facts on the basis of which the decision was entered into in the suit, delay stands condoned and this petition is ordered. 4.Registry is directed to number the appeal if it is otherwise in order. If the appeal is numbered, the name of Mr.K.Elango, learned counsel, may be printed in the cause-list.
