Respondents in all the 3 W.Ps Writ Petitions filed under Article 226 of the Constitution of India, for the issuance of writ of certiorari to call for the records relating to the proceedings of the 1st respondent dated 21.03.2014 in No.4929/VCS/REGR/ ESTT(T)/2014,(in WP.9083/14) to call for the records relating to the proceedings of the 3rd respondent dated 03.02.2014 in proceedings No.4929/REGR/ ESTT(T)/ 2014(in W.P.9084/14) and to call for the records relating to the proceedings of the Syndicate of the 1st respondent in the 130th meeting (Special) of the Syndicate held on 10.01.2014 with respect to item no.8 and to quash the above proceedings.(in WP.9085)14) For Petitioner : Mr.Niranjan Rajagopalan (in all 3 W.Ps.) Registrar also got over on 26.03.2015 and that the enquiry was also over and report has been sent to the Syndicate, the reliefs sought for in the Writ Petitions have become infructuous. 2.However, the learned counsel for the petitioner submitted that the respondents 1 & 3 have malafidely suspended the petitioner.
3.As submitted by the learned counsel for the respondents 1 & 3, since the period of suspension as well as the tenure of the petitioner as Registrar got over and the enquiry report has been sent to the Syndicate, I am of the view that nothing survives for adjudication in these Writ Petitions.
4.The learned counsel for the petitioner submitted that the first respondent may be directed to pass final order on the enquiry report within a stipulated time.
5.The learned counsel for the respondents 1 & 3 also submitted that a time limit may be fixed for passing final order on the report.
6.Having regard to the submissions made by the learned counsel on either side, the first respondent is directed to pass final order on the enquiry report dated 31.05.2014, on merits and in accordance with law, within eight weeks from the date of receipt of a copy of this order.
7.The learned counsel for the petitioner submitted that the petitioner is continuing as the Head of the Department of Criminal Law in Tamil Nadu Dr.Ambedkar Law University and he may be allowed to continue in the said post.
8.The learned counsel for the first respondent fairly submitted that the petitioner can continue as Professor in the Department of Criminal Law till a final decision is taken in the issue involved in the matter.
9.In view of the same, the Writ Petitions are dismissed as infructuous. No costs. Consequently, the connected miscellaneous petitions are closed.
