Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to pass orders on the representation made by the petitioner dated 16.12.2019 for revision of seniority and further promotion as Executive Engineer with all consequential service and monetary benefits within a reasonable time frame. This writ petition has been filed for issuance of writ of mandamus directing the respondent to revise the seniority and grant promotion to the petitioner with all consequential benefits by considering the representation made by the petitioner.
2.The case of the petitioner is that his seniority as an Assistant Engineer has to be considered and it should be placed on par with his junior. The grievance of the petitioner is that, his promotion to the post of Assistant Engineer was wrongly given effect from 29.09.1993 and it should have been given effect from 01.05.1987. representation to the respondents on 16.12.2019 in this regard. Since, the same was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.
3.Heard Mr.M.Muthappan, learned counsel appearing on behalf of the petitioner and Mr.E.Rajanliyo, learned Standing Counsel appearing on behalf of the 1st respondent and Mr.P.S.Sivashanmuga Sundaram, learned Special Government Pleader appearing on behalf of the 2nd respondent.
4.Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the 1st respondent to consider the representation made by the petitioner on 16.12.2019 and pass appropriate orders strictly in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the 1st respondent along with a copy of the earlier representation dated 16.12.2019 and a copy of this order.
6.This writ petition is disposed of with the above direction. No Costs.
