ORDER

This contempt petition has been filed to punish the respondents for disobeying the order of this Court passed in W.P.No.7036 of 2025 dated 04.03.2025.

2. Learned Government Advocate appearing for first respondent submitted that repeated notices have been sent to second respondent calling for enquiry and there is no co-operation from the second respondent. In view of the same, the first respondent is not in a position to conduct enquiry and take a decision regarding registration of the document.

3. From the materials placed before this Court, it is seen that the first respondent has issued the first notice on 29.03.2025. Thereafter, another notice was issued on 17.04.2025. The third notice was issued on 16.07.2025. The last notice was issued on 12.11.2025. Hence, at least on four occasions, notices have been issued and the second respondent is not inclined to participate in the enquiry. Hence, the petitioner and first respondent cannot be endlessly waiting for the second respondent to participate in the enquiry. Therefore, there shall be a direction to the first respondent to proceed further with the enquiry with the petitioner and if the petitioner satisfies all the requirements, the document shall be registered. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.
