Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records on the file of the Fourth Respondent in proceedings No.87/YPA/BP/2019/720 dated 02.12.2019 and quash the same and consequentially direct the Respondents herein to consider the proposals of the Petitioner herein for construction of a four storied residential buildings (6Units) in T.S.No. B/9/4, Plot No.94, 95 Yerra Gardens, Yanam Municipality,

Yanam and pass appropriate orders on merits and in accordance with law, not withstanding the pendency of the Appeal Suit or any Representation submitted by any one pertaining to the said property and to approve the plan proposal of the Petitioner if the same is otherwise in accordance with law. Since it is represented by Mr. D.Ravichander, Learned Additional Government Pleader, who takes notice for the Respondents that the concerned authorities after receiving legal opinion would take a decision on the application for planning permission made by the Petitioner by 31.03.2020, Learned Counsel for the Petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to file fresh Writ Petition in the event of the authorities failing to take any decision by then, and he has also made an endorsement to that effect. 2.
