The petitioner / wife has come up with the above transfer petition, seeking transfer of H.M.O.P.No.127 of 2024 from the file of Principal SubCourt, Palani to the file of Family Court, Coimbatore. 1/5
2. Despite service of notice in the above transfer petition, the respondent has neither chosen to appear in person nor through counsel. The name of the respondent is also printed in the cause list. Name of the respondent was called out, but there is no response. Hence, he is set ex parte. I have proceeded to hear the learned counsel for the petitioner. I have also gone through the affidavit filed in support of the request for transfer.
3. The learned counsel appearing for the petitioner would submit that the respondent husband has filed a petition to dissolve the marriage on the ground of cruelty in H.M.O.P.No.127 of 2024 on the file of Principal SubCourt, Palani.

The petitioner has stated that initially petitioner and respondent were working as Assistant Professor at Sathyamangalam and thereafter, the petitioner got a job at Canara Bank, Komarapalayam Branch, Bhavani for the post of clerk and was promoted to the post of Assistant Manager in the year 2018 and was transferred to Coimbatore Branch. The petitioner delivered a child on 07.02.2019 at Coimbatore and was living with her parents at Mettur. 2/5
The respondent was preparing for competitive exams and subsequently, secured a job in Southern Railway with a training period of 18 months at Viruthachalam and the respondent was posted as Junior Engineer at Thiruvannamalai and the respondent asked the petitioner to stay with her parents. While so, the petitioner was diagnosed with cyst in her right chest and was taking treatment initially at the respondent's residence at Villupuram and thereafter, the petitioner was staying with her mother at Coimbatore and was taking treatment. In the meantime, the respondent filed H.M.O.P.No.127 of 2024 for divorce with false allegations.

The petitioner states that she is living with her mother and taking rigorous treatment at Coimbatore and it would be extremely difficult for her to attend each and every hearing by travelling nearly 121 kms and by incurring huge amount and that apart, other than the aged mother, there is no one to accompany her to attend the Court hearings.
6. I am satisfied that the petitioner has made out a good ground for transferring H.M.O.P.No.127 of 2024 from the file of Principal Sub-Copurt, Palani to the file of Family Court, Coimbatore.
7. Accordingly, this Transfer Civil Miscellaneous Petition is allowed 3/5
and the case in H.M.O.P.No.127 of 2024 is withdrawn from the file of Principal Sub-Court, Palani and transferred to the file of the Family Court, Coimbatore. Considering the facts and circumstances of the case, there shall be no orders as to costs. Consequently, connected Civil Miscellaneous Petition is closed.
