TERMS OF SETTLEMENT The 1st claimant obtained an award before the trial forum for a sum of Rs.2,32,188/-which is under challenge by the Insurance Company.

2. The counsel for the Insurance Company seeks permission to withdraw this appeal. He also filed a memo to that effect.

3. Recording the statement of the learned counsel and the Memo filed, this Civil Miscellaneous Appeal is dismissed as withdrawn. The Court fee paid, if any, shall be refunded. Consequently, the connected MP, if any, is closed.
