O R D E R
(Order of the Court was made by S.Manikumar,J) While disposing of W.P.No.39629 of 2016, dated 15/11/2016, we directed the concerned, to dispose of the representation, dated 1/11/2016, as expeditiously as possible and not later than, ten days, from the date of receipt of a copy of this order, made in W.P.No.39629 of 2016. That apart, having regard to the grievance of the writ petitioner that he was not paid salary from the month of September onwards, we directed that the same may also considered.
2. Contending inter alia that the respondents have disobeyed the order of this Court, instant Contempt Petition is filed.
3. On this day, when the matter came up for hearing, Mr.M.Rajendran, learned counsel for the petitioner contended that salary has been paid. However, the respondents, without considering the representation, dated 1/11/2016, in proper perspective, passed an order, which according to him, is contumacious.
4. Material on record discloses that the representation, dated 1/11/2016, of the writ petitioner has been considered and vide, order, dated 5/12/2016, the Director of Central Board for Workers Education Department, Chennai, held that there is no extenuating circumstances, warranting cancellation/modification of the order of the transfer.
5. While disposing of the writ petition, we only directed the representation, dated 1/11/2016, to be considered. Payment has been made. Representation has been considered. There is absolutely no case for invoking the provisions of the Contempt of Courts Act.
6. In view of the above, Contempt Petition is dismissed. No costs. (S.M.K.,J) (N.A.N.,J) 10th August 2017.
