ORDER
The petitioner, who was arrested and remanded to judicial custody on 25.01.2025 for the alleged offence punishable under Section 87, 351(2) of BNS and section 5(k) and 6(1) of POCSO Act, 2012 in Crime No.5 of 2025 on the file of the respondent police, seeks bail.
2. This Court earlier considered the bail application of the petitioner and dismissed the same on merits in Crl.O.P. No. 23836 of 2025 dated 03.09.2025. After perusing the statement of the victim and other materials, the Court observed that the petitioner may renew the application after examination of the victim girl and the de facto complainant.
3. The learned counsel for the petitioner submitted that now PW1 and PW2 have been examined. Hence, he has come forward with the present petition and seeks bail.
4. I have also gone through the records; however, the statement of the victim girl has not been produced before me to verify the nature of the evidence tendered by her before the Trial Court. Without seeing the same, I am not in a position to decide the bail petition.
5.Hence, I am of the view that the petitioner shall first approach the Trial Court and file a petition seeking bail. Thereafter, if any adverse order is passed, he can approach this Court. With this liberty, this petition is dismissed with a direction that the petitioner shall approach the Trial Court. 23-01-2026 Mpa
