C.M.P.Nos.1973, 1939 and 1945 of 2023 in S.A.No.766 of 2021 P.T.ASHA, J These petitions have been filed by the petitioners to condone the delay of 39 days in filing the petition to set aside the abatement caused due to the death of the sole appellant, P.S.Arumugam in the above second appeal; to set aside the abatement caused due to the death of the deceased appellant, P.S.Arumugam and to bring on record the petitioners 2 to 5 as legal representatives of the deceased appellant in the above Second Appeal.

2. Heard the learned counsel appearing for the petitioners and the learned counsel for the sole respondent/caveator.

3. Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and the petitions are allowed. The Registry is directed to carry out the necessary amendments.
