This petition is filed to condone the delay of 93 days in filing the above Civil Miscellaneous Appeal.

2.Mr.S.Sivakumar, the learned counsel takes notice for the respondent.

3.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 93 days is condoned and the petition is ordered.

4.The learned counsel appearing for the petitioner is directed to serve typed set of papers to the respondent.
