PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to grant permission to conduct jallikattu event in the ground of Anbu Education Institution at Komarapalayam, Namakkal District by following the Tamil Nadu Regulation of Jallikattu Act, 2009 and the Tamil Nadu Prevention of Cruelty to Animals (Conduct of Jallikattu) Rules 2017 and also considering petitioner's representation dated 30.1.2017.

ORDER

(Order of the Court was made by T.MATHIVANAN,J) Invoking the provisions of Article 226 of The Constitution of India, this writ petition has been filed by the petitioner seeking a direction in the nature of a Writ of Mandamus to direct the first respondent to grant permission to conduct jallikattu event in the ground of Anbu Educational Institution at Komarapalayam, Namakkal District subject to the provisions of the Tamil Nadu Regulation of Jallikattu Act, 2009 and the Tamil Nadu Prevention of Cruelty to Animals (Conduct of Jallikattu) Rules 2017 and also to consider the representation of the petitioner dated 30.1.2017.

2. On perusal of the averments in the affidavit filed in support of this writ petition, it is manifested that the petitioner is one of the coordinators of Namma Komarapalayam Organization. It is submitted that the petitioner had sent a representation dated 30.1.2017 to the first respondent seeking permission to conduct Jallikattu event in the ground of Anbu Educational Institution, Komarapalayam Taluk, Namakkal District. However, his representation has not yet been considered. That is why he stands before this Court with this writ petition.

3. Heard the learned counsel on either side.

The learned Additional Government Pleader appearing for the respondents has drawn the attention of this Court to page 2 of the typed set of papers wherein the Bill, introduced in the Legislative Assembly of the State of Tamil Nadu with reference to conduct of Jallikattu in the State of Tamil Nadu, is available. She has further submitted that the first respondent might be directed to consider the representation of the petitioner dated 30.1.2017 subject to the conditions envisaged or enumerated under Regulation 3(2) of the said Bill.

5. After considering the submissions made on behalf of both sides, we find that the first respondent man be directed to consider the representation of the petitioner dated 30.1.2017.

6. Accordingly the writ petition is disposed of with a direction to the first respondent to consider the representation of the petitioner dated 30.1.2017 to grant permission to the petitioner for the conduct of Jallikattu, subject to the

procedures envisaged in the Tamil Nadu Regulation of Jallikattu Act, 2009 and Appendix to G.O.(Ms).No.7 Animal Husbandry Dairying and Fisheries (AH3) Department dated 21.1.2017, within a period of two weeks from the date of receipt of a copy of this order. No costs.
