A.No.223 of 2022 in I.P. No.167 of 2001 KRISHNAN RAMASAMY,J.

This application has been filed, seeking a direction to permit the Official Assignee to disburse a sum of Rs.85,052/- to the only proved unsecured creditor K.Sivaraman.

2.According to the Official Assignee, there were 7 unsecured creditors, who have filed claims for a total sum of Rs.4,98,067/-, of which, the claim filed by one K.Sivaraman in Claim No.28 of 2002 for Rs.85,052/- was admitted for the same amount, by order dated 13.08.2003 and the claim filed by one Mrs.Sarojini, W/o Sundaralakshmi, 3rd party purchaser herein in Claim No.86 of 2017 for a sum of Rs.80,000/- was withdrawn as not pressed and the other 5 claims were dismissed. Therefore, the learned Official Assignee would submit that on verification of the records, as far as the claim filed by K.Sivaraman for a sum of Rs.85,052/- is genuine and proved unsecured creditor and hence, he would urge this Court to permit him to disburse the said amount.

Considering the submissions made by the learned Official Assignee, permission is granted to disburse the amount of Rs.85,052/- (Rupees eighty five thousand and fifty two only) to the unsecured creditor, namely, K.Sivaraman within a period of two weeks from the date of receipt of a copy of this order.
