ORDER

Seeking a direction to the first respondent police to entrust the petitioner's complaint dated 23.09.2014 to the 2nd respondent for registering FIR against the named person, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. From a perusal of the materials available on record, it is seen that on the petitioner's complaint, the petition enquiry was conducted and closed by the respondent police.

4. The learned counsel for the petitioner submitted that the petitioner has obtained sufficient materials from the Tahsildar, Bhavani. The Community Certificate given by the opposite party is a fake and fabricated document.

5. If that is so, the petitioner is given liberty to give a fresh complaint along with supporting documents to the concerned police and on the complaint being received, the same shall be enquired into by the said police in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)].

6. This Criminal Original Petition is disposed of with the above direction.
