The present Criminal Original Petition has been filed seeking to quash the proceedings in S.T.C.No.856 of 2024 pending on the file of the Judicial Magistrate Court No.I, Ariyalur.
The submissions of the learned counsel appearing for the petitioner are follows:- 2.1. Based on the complaint given by the second respondent/de facto complainant, a case in Crime No.1113 of 2020 was registered for the offences under Sections 143, 341, 269, 270 and 271 of the IPC, in which the petitioner was arrayed as A7. 2.2. After completion of investigation, the final report was filed before the Judicial Magistrate Court No.I, Ariyalur, and the Court took cognizance of the same and numbered it as S.T.C.No.812 of 2020. 2.3. Later, in the year 2024, the case was split up against the petitioner and two others and re-numbered as S.T.C.No.856 of 2024 before the same Court.
2.4. One of the co-accused in Crime No.1113 of 2020 has filed a petition before this Court in Crl.O.P.No.23802 of 2025 seeking to quash the proceedings in S.T.C.No.812 of 2020, which had arisen from 2/5
Crime No.1113 of 2020. This Court, finding that the materials collected by the prosecution would not constitute any offence and that directing the parties to undergo ordeal of trial would be a futile exercise, quashed the proceedings against him vide order dated 11.09.2025. 2.5. Therefore, continuing the proceedings against the petitioner, which rests on the very same set of evidence, would be an abuse of process of law. Hence, he prayed to quash the proceedings pending against the petitioner in S.T.C.No.856 of 2024. 3.
Learned Additional Public Prosecutor appearing on behalf of the first respondent police endorsed the aforesaid submissions of the learned counsel for the petitioner, stating that the proceedings against the coaccused have already been quashed by this Court. 4.
Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the fact that the proceedings against the similarly placed co-accused in Crime No.1113 of 2020 were quashed by this Court in Crl.O.P.No.23802 of 2025 vide order dated 11.09.2025, this Court is of the opinion that no useful purpose would be served in continuing with the impugned proceedings. 3/5
Therefore, this Court is inclined to quash the proceedings pending against the petitioner in S.T.C.No.856 of 2024, pending on the file of the Judicial Magistrate Court No.I, Ariyalur, in exercise of its jurisdiction under Section 482 Cr.P.C./Section 528 BNSS.

Accordingly, this Criminal Original Petition stands allowed and the proceedings in S.T.C.No.856 of 2024, pending on the file of the Judicial Magistrate Court No.I, Ariyalur, is quashed in entirety. Consequently, the connected miscellaneous petition is closed. 10.02.2026 ham To 1.
