ORDER

The petitioner, who was arrested and remanded to judicial custody on 31.12.2025, for the alleged offence punishable under Sections 296(b), 118(1), 351(3) of BNS Act @ 296(b), 118(1), 351(3), 108 of BNS, in Crime No.539 of 2025 on the file of the respondent police seeks bail. 1/4

2. The allegation against the petitioner is that he joined hands with other accused, had advanced a loan of Rs.50,000/- to the deceased. As the deceased was unable to repay the said amount, the petitioner joined hands with other accused went to the house of the deceased, forcibly dragged him into the street in in a public view, abused him in filthy language and assaulted him for nonpayment of the loan amount. Unable to bear the humiliation and harassment, the deceased consumed poison. Hence, a complaint was lodged and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner is 50% disabled person and that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally two accused in this case and the petitioner is ranked as A2. He further submitted that the petitioner was arrested recently on 31.12.2025 and that the investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the manner in which the petitioner misbehaved with the deceased, assaulted him in a public view, dragged him on the street, and 2/4

allegedly tied a towel around the neck of the deceased, resulting in severe humiliation, which ultimately led the deceased to commit suicide, therefore, this Court is not inclined to grant bail to the petitioner.
