ORDER
The petitioner, who apprehend arrest for the alleged offences punishable under Sections 406 and 420 of IPC, in Crime No.232 of 2024, on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant along 1/4
with 85 persons had availed the petitioner / accused travel agency for trip to Malaysia in the year of 2023. In guise of which the petitioner / accused person travel agency had collected a sum of Rs.40,00,000/- (Rupees Forty Lakhs) and not arranged the trips to them accordingly, thereby cheated the said amount. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged by the respondent police. He further submitted that the petitioner had already paid a part of the amount to the defacto complainant and is now he ready to pay of Rs.6,50,000/-. Hence he prays for the grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner is not inclined to deposit the amount as per the order of this Court on 23.01.2025. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. The learned counsel for the intervenor submitted that a balance 2/4
amount of Rs.8,52,000/- is yet to be paid by the petitioner.
6. Consideration the facts and circumstances of the case, the petitioner failed to comply with the order passed by this Court on 23.01.2025. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
