PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents 1 and 2 to give appropriate instructions to the 4th and 5th respondents to correct and include the present survey number of all that piece and parcel of total extent of land in 11 Are 10 Santhiyar or 82 Kuzhi 62/64 in one portion of downside of Mr.Nagamuthupillai's backyard to an extent of 67 Santhiyar or 05 Kuzhi and situated in Niravi Kombyun, Keelatheru, Melaoduthurai Village, Koimoon Panchayat, Niravi Sub-District, Pondicherry Registration District registered as Document RV.No.144/60/1948 before SRO, Karaikal and the property bounded on the North by Street; South by Wetland's of Mr.Rajagopalu Naicker; West by Purchaser's house and garden; East by Mr.Angamuthu Pillai's house and garden; which is now in the possession of the petitioner and consequently to demarcate the same which is in the possession of the petitioner. ORDER
With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
2. To the representation made by the petitioner seeking for inclusion of his name and for execution of joint patta, an enquiry seems to have been commenced by the third respondent.
3. The learned counsel for the petitioner would submit that he would be satisfied, if the third respondent is directed to complete the enquiry within a stipulated time.
4. Taking into consideration the submission made by the learned counsel for the petitioner and the limited prayer sought for, there shall be a direction to the third respondent herein to complete the enquiry, pursuant to the summons issued by the Branch Survey Office, Settlement Section, Karaikal in No.360/SETT/KKL/2016, dated 17.07.2019, within a period of 12 weeks from the date of receipt of a copy of this order.
5. Accordingly, the Writ Petition stands disposed of. No costs. 3/5
