ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(b) of BNS Act (Corresponding Section 379, 430 of IPC) in connection with the Cr.No.8 of 2026, seeks anticipatory bail.

2. The allegations against the petitioner are that on 07.01.2026, while the respondent police were patrolling in Veeralur, Krishnan Bricks industries, they found the petitioner along with other accused illegally transporting 1 unit of sand in Tractor bearing Reg.No.TN 25 BF 7565. On seeing the respondent police, accused escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person, and he has been falsely implicated in this case by the respondent police. He further submitted that petitioner is ready to abide any stringent condition that may be imposed by this Court and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instructions, submitted that the petitioner herein has been arrayed as A2 in this case. She further submitted that the 1 unit of sand and a tractor were seized by the respondent police, the investigation in this case is still pending and opposed for grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the nature of allegations, the submissions made by learned counsels on either side and also considering the fact that the petitioner is not only illegally quarried sand but also caused damage to the ecology, this Court is not inclined to grant anticipatory bail to the petitioner.
