C.M.P.No.1117 of 2023 in C.M.A.SR.No.4414 of 2023 N.MALA,J, This Petition has been filed to condone the delay of 104 days in filing the above appeal against the order dated 22.04.2022 made in M.C.O.P.No.2541 of 2019, on the file of the Motor Accidents Claims Tribunal, III Court of Small Causes, Chennai.
2. The learned counsel for the petitioner submits that the notice to the first respondent may be dispensed with, as the first respondent remained ex-parte in the Court below. Though, notice was served to the second respondent, he has not appeared in person or through counsel before the Court.
3. I have gone through the affidavit in support of the petition and I am satisfied with the reasons stated therein, therefore, the delay of 104 days is condoned.
4. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.
Accordingly, this CMP is ordered.
