No. 498 / 2F2 and 397.61 sq.ft in S. No 498 / 2G in all measuring an extent of 453-5 sq.ft in S. Nos. 498/2G and 498/2F2 Virupatchipuram village, Dharmapuri Taluk and District and pay the compensation to the petitioner in accordance with the provisions of Central Act 30 of 2013, within such time as may be fixed by this Honourable Court.

Directing the respondent authority to fix the value for the building trees and bore-well available in the land measuring 576 sq.ft ( 53.51 sq.mtr) in S. No 498 / 2F2 and 400 sq.ft ( 37.16 sq.mtr) in S. No 498 / G.Virupatchupuram Village, Dharmapuri Taluk and District which have been acquired by the respondent authority covered under the award dated 25.04.2023 was passed relating to the land excluding building trees and bore-well and grant compensation for the same as per petitioners representation dated 13.12.2023 within such time as may be fixed by this Honourable Court For Petitioner(s):

ORDER

These writ petitions have been filed to direct the respondents to consider the petitioner's representations dated 21.07.2023 & 13.12.2023.

The learned counsel for the petitioner would submit that in this case, the petitioner has given the representations dated 21.07.2023 & 13.12.2023 requesting the respondents for correction and re-computation of the compensation payable to the petitioner in respect of the land . However, the said representations were not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned counsel appearing for the respondent would submit that the petitioner's representations dated 21.07.2023 & 13.12.2023 will be disposed of by the respondent within a period of 8 weeks.

4. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of

the matter, this Court directs the respondents to consider the representation of the petitioner dated 21.07.2023 & 13.12.2023 and dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order. Further, if the petitioner's representations are rejected by the respondents, the petitioner is granted liberty to challenge the rejection order as well as the original award dated 29.03.2023 within a period of 4 weeks from the date of passing of said rejection order.

6. With the above directions, these writ petitions are disposed of.
