This petition has been filed seeking to condone the delay of 191 days in filing the above appeal against the judgment and decree dated 14.03.2022 made in O.S.No.446 of 2020, on the file of XVIII Addl. City Civil Court, Chennai.

2. Mr.S.Umpathy, learned counsel for appellants submitted that though the certified copies obtained in time, due to appellant's ill-health and also due to other business pressure, he could not engage a new counsel and to file an appeal in time. Hence, there is a delay of 191 days in filing this petition arose and accordingly, he filed this petition to condone the delay in filing the above appeal.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Appeal if it is otherwise found to be in order.

4. Issue notice to the respondent through court returnable by 07.06.2023. Private notice is also permitted.

5. Post the matter on 07.06.2023.
