This original petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to securities of Lekha Srinaath, who was the wife of the 1st petitioner and the mother of the 2nd and 3rd petitioners. She died on 08.01.1999. There is a specific statement made in the petition that no similar petition had been filed in any other Court. It is stated that the deceased had share certificates of M/s.Shree Cement Limited, which had been given in the schedule to the petition.

2.After effecting paper publication, the petitioners were invited to adduce evidence. The 1st petitioner examined himself as PW-1. The death certificate of Lekha Srinaath was marked as Ex.P1 and the legal heirship certificate of Lekha Srinaath was marked as Ex.P2. The correspondence relating to shares were marked as Ex.P4. Smv 3.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in the name of the 2nd petitioner, Adithy Srinaath, provided the shares are actually available with the named company, M/s.Shree Cement Limited.
