Mr.A.Selvendran, learned Special Government Pleader accepts notice for respondents. With the consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.
2. This writ petition has been filed seeking for issuance of a writ of mandamus, directing the third respondent to comply the direction issued by the second respondent vide his proceedings in Oo.Mu.A8/8481/2023, dated 19.10.2023, pursuant to petitioner's representation dated 07.10.2023. Pg.Nos.2/6
3. The grievance of the petitioner is that he has given a representation to the respondents on 07.10.2023, seeking to make necessary corrections in the UDR and issue Patta in favour of the petitioner in respect of the property in House Plot No.93 in S.No.663/1, measuring an extent of 5 cents in Kurinji Village, Coimbatore Taluk, Coimbatore District. While so, the second respondent vide proceedings dated 19.10.2023, directed the third respondent to take appropriate action on the representation of the petitioner. Since there was no response from the third respondent till date, the present writ petition has been filed.
4. Having regard to the submissions made by the learned counsel on either side, this Court, at this stage, is not expressing any view on the merits of the matter, as it is for the third respondent/Tahsildar to consider and decide the same on merits and in accordance with law. Since this Writ Petition is only for a mandamus to consider the representation, this Court Pg.Nos.3/6
directs the third respondent to consider the representation of the petitioner dated 07.10.2023 and pass appropriate orders on merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as rival claimants/interested parties, if any, as the case may be within the stipulated time as stated in Circular No.R1/2005632/2022 dated 17.07.2023 issued by the Commissioner of Land Administration.
5. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
