This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925, seeking succession certificate with respect to the securities of A.N.Vallikannu, who died intestate on 26.02.2021.
2. The petitioner is the son of the deceased. The first respondent his her husband and the second respondent is her daughter. The respondents have given consent affidavits for grant of succession certificate. The deceased was possessed of securities as stated in the schedule to the petition.
3. Publication has been effected. The petitioner examined himself as PW1. Death certificate of his mother was marked as Ex.P1 and legal heirship certificate was marked as Ex.P2. The share certificate was marked as Ex.P3. The consent affidavits were marked as Exs.P4 & P5.
4. Considering the evidence adduce, this Court holds that the petitioner is entitled to grant of succession certificate with power to collect the securities and to receive interest and dividends on and to negotiate and transfer the securities specified in the schedule to the petition.
