ORDER

This Criminal Revision Case has been filed by the petitioner to set aside the order dated 28.10.2024 passed in Crl.M.P.No.58976 of 2024 in C.C.No.2799 of 2024 in Crime No.99 of 2022 pending on the file of the Additional CCB-CID Metropolitan Magistrate at Egmore, Chennai.

2. The case of the petitioner is that the petitioner filed a petition in Crl.M.P.No.58976 of 2024 before the Metropolitan Magistrate, for Exclusive Trial of CCB Cases (Relating to Cheating Cases in Chennai), and CBCID Metro Cases, Egmore, Chennai, under Section 497 read with 503 of B.N.S.S. for return of passport bearing No.M8472941, Original Sale Deed Document No.804 of 2018, Original Sale Deed Document No.6243 of 2017 and Original Mortgage Deed Document No.261 of 2018 to the petitioner pending investigation in Crime No.99 of 2022, whereas the learned Magistrate failed to consider the same and dismiss the petition by order dated 28.10.2024 on the ground that the investigation is pending. Hence, the present Revision is filed. 2/5

3. Heard both sides and perused the materials available on record.

4. It is seen that now the charge sheet has been filed and the same has been taken on file in C.C.No.2799 of 2024 on the file of the Additional CCBCID Metropolitan Magistrate at Egmore, Chennai.

5. Therefore, this Criminal Revision Case is disposed of with liberty to the petitioner to approach the trial Court.
