This Writ Petition has been filed by the Revenue calling in question the correctness of the order passed by the Tamil Nadu Sales Tax Appellate Tribunal (Main Bench) Chennai-104 dated 19.11.2001, in T.A.No.149/2000. https://hcservices.ecourts.gov.in/hcservices/
2. When the matter is taken up for hearing, the learned Government Advocate appearing for the Department brought to our notice the Circular instruction issued by the Commissioner of Commercial Taxes, Chepauk, Chennai - 5 vide Circular No.1/2019, dated 05th August,2019, wherein, it is stipulated that Writ Petition shall not be filed/pursued by the Department before the High Court in cases where the tax effect does not exceed Rs.5,00,000/- (Rupees Five Lakhs only).
Therefore, the learned Government Advocate seeks permission of this Court to withdraw this Writ Petition. She has also made an endorsement to that effect.
3. In the instant case, the tax effect is said to be less than the monetary limit imposed and, therefore, the Writ Petition filed by the Revenue is dismissed, as withdrawn.
No costs.
Consequently, connected Miscellaneous Petition is closed.
