JUDGMENT

This Civil Miscellaneous Appeal has been filed against the order made in W.C.No.115 of 2007 dated 18.02.2012 on the file of Workmen's Compensation Commissioner Tribunal/ Deputy Commissioner of Labour, Salem.

2. It is informed before this Court that on 13.08.2014 notice was issued to the parties to appear before the Mega Lok Adalat on 20.09.2014. It was informed that said notice issued to the claimant has been returned as the party was deceased. After that also, there was no steps taken by the appellant to bring the legal heirs on record.

2. They obtained a interim direction on 26.06.2013, directing the Commissioner of Workmen's Compensation (Office of the Deputy Commissioner of Labour), Salem to withhold the payment of the award amount of Rs.3,25,344/-, which was deposited in W.C.115 of 2007 dated 18.02.2012, pending disposal of CMA.No.2126 of 2013. returned as died and no steps has been taken to bring the legal heirs on record.

3. Since there is no representation on behalf of the appellant and also no steps have been taken, this Court dismisses the Civil Miscellaneous Appeal for default. No costs.
