Petition filed under Section 397 read with 401 of the Criminal Procedure Code, to set aside the conviction dated 22.08.2017 made in C.A.No.104 of 2016 on the file of the 1st Additional District, Sessions Judge Tiruppur, confirming the conviction imposed in judgment dated 29.08.2016 made in C.C.No.132 of 2013 on the file of the Ld Judicial Magistrate FTC, Tiruppur.

O R D E R

This Criminal Revision Petition is filed to set aside the conviction dated 22.08.2017 made in C.A.No.104 of 2016 on the file of the 1st Additional District, Sessions Judge Tiruppur, confirming the conviction imposed in judgment dated 29.08.2016 made in C.C.No.132 of 2013 on the file of the Ld Judicial Magistrate FTC, Tiruppur.

2. A joint memo of compromise is filed and the amount disputed between the parties have been settled. The memo of compromise filed by the parties, signed by the respective counsel is recorded.

3. It is submitted that at the time of admission of Crl.R.C.No.1480 of 2017, conditional order was passed for depositing Rs.7,00,000/- in CRL.M.P.Nos.14692 & 14694/2017. In view of the compromise, the revision petitioner is permitted to withdraw Rs.7,00,000/- which was deposited by them.

4. Accordingly, the criminal revision petition is allowed and the sentence imposed by the lower Court in C.C.No.132 of 2013 is set aside.
