This Criminal Original Petition has been filed to direct the respondents to register the complaint dated 15.11.2021 given by the petitioner.
2.The grievance of the petitioner is that the petitioner had lodged a complaint on 15.11.2021, thereafter, C.S.R No. 502 of 2021 assigned, but no action taken. Further,the petitioner has been threatened by one Kumunan, a dismissed police personnel and one Alagiri, who had taken the petitioner's Tata Ace vehicle. Hence, the petitioner seeks protection for herself and also from the recovery agency of the finance company. 3.The learned Additional Public Prosecutor submits that the petitioner's husband had taken hypothecation loan from Shriram City Union Finance Ltd., and purchased a vehicle on hire purchase and one Alagiri stood as guarantor for the same. petitioner failed to make the payment of EMI to the finance company, therefore, the said Alagiri being the guarantor was questioned, thereafter, the said Alagiri taken custody of the vehicle and retained the same. This has happened four years before. The said Alagiri had paid the Shriram City Union Finance Ltd., and demanded the petitioner's husband to make payments, which is now projected as though recently happened and the petitioner is being threatened.
4.Considering the submissions and on a perusal of the materials, It is seen that with regard to the dispute in repayment of the loan, the incident had taken place four years before and the only allegation to be considered is that the petitioner is being threatened by Kumunan and Alagiri. The respondents police is directed to provide police protection for the life of the petitioner. Accordingly, this criminal original petition is disposed of.
