O R D E R
The relief sought for in the present writ petition is to direct the respondents to restore electricity connection vide S.C.No.093190041016 based on the representations submitted by the petitioner respectively on 04.09.2023 and 03.01.2024.
2. The learned counsel for the petitioner would submit that the petitioner committed default in payment of electricity consumption charges and thus the electricity service connection was disconnected. Now the petitioner is ready to pay the electricity consumption charges.
3. The learned Standing Counsel appearing on behalf of the respondent-TANGEDCO would oppose the contentions raised on behalf of the petitioner by stating that the petitioner can restore the electricity service connection within a period of two years from the date of disconnection of electricity service connection. Since three years lapsed, the disconnected electricity service connection cannot be restored. But the petitioner has to submit fresh application for electricity service connection. Therefore, the petitioner is at liberty to submit fresh application for providing electricity service connection and in the event of submitting any such application by the petitioner, the same is to be considered on merits by the respondentTANGEDCO.
4. The learned Standing Counsel appearing on behalf of the respondent-TANGEDCO would further submit that the civil suit between the parties is pending and there are other issues which all are also to be considered by the respondent-TANGEDCO. Thus, it is left open to the Authorities concerned to consider all the issues, while scrutinising the
application, if any, filed by the petitioner, seeking fresh electricity service connection by following the procedures.
5. With the above observations, the present writ petition stands disposed of. However, there shall be no order as to costs. 22-01-2024 Index : Yes/No Internet: Yes/No Speaking order/Non-Speaking order Svn
