The present Civil Miscellaneous Application has been filed by the appellant seeking to restore the Second Appeal which had been dismissed for non prosecution on 14.12.2018.

2.This Court had placed a condition that the learned counsel must be prepared to argue the appeal itself.

3.The learned counsel is prepared for arguing the appeal.

Therefore let me grant some further time to work out the points of law which have to be argued.

4.In the affidavit filed, it had been stated that two or three cases were called simultaneously and consequently the learned counsel had appeared before the Court on 14.12.2018.

5.Reasons stated are accepted and the Civil Miscellaneous Petition is allowed.
