Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition (viz. "The Appellant shall appear before the learned XI Additional Special Sessions Judge CBI Cases Relating to Banks and Financial Institutions), Chennai at 10.30 a.m. on the first working day of every English Calendar Month") imposed on the petitioner in Crl.MP.No.40 of 2020 in Crl.A.No.2/2020.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.R.RAMESH KUMAR, Advocate for the Petitioner and of MR.K.SRINIVASAN, Special Public Prosecutor for CBI Cases on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.40 of 2020 in Crl.A.No.2 of 2020 by order dated 08.01.2020 directing the petitioner to appear before the learned XI Additional Special Sessions Judge (CBI Cases Relating to Banks and Financial Institutions), Chennai, at 10.30 a.m. on the first working day of every English Calendar Month, pending appeal.
2. The learned counsel for the petitioner would submit that the petitioner had applied for suspension of sentence and this Court by order dated 08.01.2020 suspended the sentence with a condition that the petitioner shall appear before the trial Court at 10.30 a.m. on the first working day of every English Calendar Month, pending appeal. He would submit that the petitioner is a senior citizen and permanent resident of Bangalore and thereby, he finds it difficult to travel from Bangalore to Chennai every month. Hence, he prays relaxation.
3. Heard the learned Special Public Prosecutor for CBI Cases appearing for the respondent police.
4. In view of the above submission, the condition imposed on the petitioner in Crl.M.P.No.40 of 2020 in Crl.A.No.2 of 2020 by order dated 08.01.2020 is modified to the effect that the petitioner shall appear before the trial Court once in every three months on the first working day of the particular month at 10.30 a.m. starting from April 2021, until further orders.
