PRAYER Calling for the records relating to the impugned order passed by the 2 nd respondent in Na. Ka. No. 4015/E/21 dated 28.09.2022 and the consequential order of the 2 nd respondent issued in Na. Ka. No. 4015/E/21 dated 24.11.2022 and quash the same and consequently to direct the 1 st and 2 nd respondents to permit the petitioner to continue the Pradhan Mantri Matsya Sampada Yojana Scheme for which the petitioner has already completed all the works and produced all the documents to the 1 st and 2 nd respondents.

ORDER
This writ petition has been filed challenging the impugned proceedings of the 2 nd respondent dated 28.09.2022 and consequently direct the 1 st and 2 nd respondents to permit the petitioner to continue the Pradhan Mantri Matsya Sampada Yojana Scheme and a consequential direction to the 1 stand 2 nd respondents to permit the petitioner to continue the same.
2. Heard Mr.T.Ranganathan, learned counsel for the petitioner and Mr.U.Baranitharan, learned Additional Government Pleader for the respondents.
3. It is not necessary for this Court to go into the various grounds raised in the writ petition, in view of the stand that was taken in the counter affidavit
filed by the 1st respondent. The relevant portion in the counter affidavit is extracted hereunder:
"21) It is submitted that in the above circumstances and reasons stated above, the work order given to the Petitioner is cancelled and work order has been issued to Mr.Thiruselvam S/o Marudayan, Adhamangalam village, an alternate beneficiary on 25.10.2022. It is also submitted that the Fisheries & Fishermen welfare department is also ready to allot the same component ie. Establishment of New Freshwater Finfish hatchery to the petitioner under 2021-22, if the petitioner produce valid land documents for the proposed hatchery in a reasonable time limit. The prayer of the petitioner has no merits and also has no locus standi to file this Writ petition."
4. In view of the above, it is seen that the work order has already been issued to one Thiruselvam, who is the alternative beneficiary, on 25.10.2022. A stand has also been taken to the effect that the department is ready to allot the same component to the petitioner, if the petitioner produces valid documents. In view of the same, in future, it will be left open to the petitioner to produce the relevant documents and satisfy the requirements and the same will be considered and allotments will be made to the petitioner.
5. This writ petition is disposed of with the above terms. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 18-06-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
