Crl.O.P.No.1392 of 2023 and Crl.A.SR No.31367 of 2023 Crl.O.P.No.1392 of 2023 and Crl.A.SR.No.2829 of 2023 R.HEMALATHA, J.
This petition is filed under Section 378 (4) Cr.P.C, to grant special leave to prefer an appeal against the judgment dated 09.11.2022 made in C.C.No.103 of 2018 on the file of the Judicial Magistrate / Fast Track Court, Kallakurichi.
2. Heard Ms.R.Meenakshi Devi, learned counsel for the petitioner.
3. Learned counsel for the petitioner contended that though the accused admitted his signature on the impugned cheque, the trial Court acquitted the accused and held that the complainant did not prove that there was an existing legally enforceable debt as against the accused. 4.In the said circumstances, there are arguable points in the main appeal and therefore, special leave is granted as prayed for. 1/2 https://www.mhc.tn.gov.in/judis
